It is vital that all members know their rights and responsibilities pertaining to the Hatch Act.<\/p>\n<p><strong><a class=\"external\" href=\"http:\/\/us02web.zoom.us\/meeting\/register\/tZcuce6oqTosHNO-VVwqL6jdhMduggWa0gVk\" target=\"_blank\" rel=\"noopener noreferrer\">Click here to register.<\/a><\/strong><\/p>\n<p>The Hatch Act is a federal law passed in 1939. The Hatch Act limits certain political activities and restricts postal and federal employees from engaging in partisan political activity while on the clock or on postal or federal property.<\/p>\n<p>&nbsp;<\/p>\n<div class=\"entity-paragraphs-item left-text-right-img-sec para-no-bg\" data-anchor=\"\">\n<div class=\"inner animate fade-in-from-bottom animated\">\n<p><strong>President Mark Dimondstein and Legislative &amp; Political Director Judy Beard<\/strong><\/p>\n<\/div>\n<h5 style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>The HATCH ACT<\/strong><\/span><\/h5>\n<div class=\"inner animate fade-in-from-bottom animated\">\n<div class=\"inner-sec-wrap clearfix\">\n<div class=\"left-col-sec\">\n<p>No one likes their rights being infringed upon. The Hatch Act is a law that does exactly this to federal and postal employees. The Hatch Act directs what activities we can and cannot do during partisan elections.<\/p>\n<p>The Hatch Act became law in 1939. There have been several legal challenges made on many of the Hatch Act restrictions concerning the 1st Amendment (free speech), 5th Amendment (due process), 9th Amendment (protection against invasion of the Bill of Rights). These losses in court have not stopped efforts to amend the Hatch Act.<\/p>\n<p>Making changes in this law requires congressional action. We encourage every APWU member to exercise their rights to the fullest extent the law permits. Please review this document.<\/p>\n<p>If you have any questions, you can contact the APWU Legislative Department at 202-842-4211 or the U.S. Office of Special Counsel, whose job is to enforce the Hatch Act, 202-254-3650.\u00a0<a class=\"external\" href=\"https:\/\/osc.gov\/Services\/Pages\/HatchAct-Federal.aspx\" target=\"_blank\" rel=\"noopener noreferrer\">They also have additional information on their website here<\/a>.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"entity-paragraphs-item two-col-img-txt-btn-sec para-no-bg\" data-anchor=\"\">\n<div class=\"inner animate fade-in-from-bottom animated\">\n<p><strong>PERMITTED AND PROHIBITED ACTIVITIES<\/strong><\/p>\n<p><strong>Information obtained from the U.S. Office of Special Counsel<\/strong><\/p>\n<div class=\"inner-sec-wrap\">\n<div class=\"two-col-sec\">\n<div class=\"two-col-sec-desc\">\n<p><strong>Permitted Activities<\/strong><\/p>\n<ul>\n<li>May\u00a0be candidates in non-partisan elections.<\/li>\n<li>May\u00a0register and vote as they choose.<\/li>\n<li>May\u00a0assist in voter registration drives.<\/li>\n<li>May\u00a0contribute money to partisan groups and candidates in partisan elections.<\/li>\n<li>May\u00a0attend political fundraisers.<\/li>\n<li>May\u00a0attend and be active at political rallies and meetings.<\/li>\n<li>May\u00a0join, be active, and hold office in partisan groups.<\/li>\n<li>May\u00a0sign and circulate nominating petitions.<\/li>\n<li>May\u00a0campaign for or against candidates in partisan elections.<\/li>\n<li>May\u00a0make campaign speeches for candidates in partisan elections.<\/li>\n<li>May\u00a0distribute campaign literature in partisan elections.<\/li>\n<li>May\u00a0campaign for or against referendum questions, constitutional amendments, or municipal ordinances.<\/li>\n<li>May\u00a0express opinions about political issues.<\/li>\n<li>May\u00a0express opinions about partisan groups and candidates in partisan elections while not at work or using official authority.<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<div class=\"two-col-sec\">\n<div class=\"two-col-sec-desc\">\n<p><strong>Prohibited Activities<\/strong><\/p>\n<ul>\n<li>May not\u00a0be candidates in partisan elections.<\/li>\n<li>May not\u00a0use official authority to interfere with an election or while engaged in political activity.<\/li>\n<li>May not\u00a0invite subordinate employees to political events or otherwise suggest that they engage in political activity.<\/li>\n<li>May not\u00a0knowingly solicit or discourage the political activity of any person with business before the agency.<\/li>\n<li>May not\u00a0solicit, accept, or receive political contributions (including hosting or inviting others to political fundraisers) unless both persons are members of the same federal labor or employee organization, the person solicited is not a subordinate employee, the solicitation is for a contribution to the organization\u2019s political action committee, and the solicitation does not occur while on duty or in the workplace.<\/li>\n<li>May not\u00a0engage in political activity while on duty, in the workplace, wearing a uniform or official insignia, or in a government vehicle.
